3-Acre Rule: Are you exempt?

The Vermont Legislature has required the Agency of Natural Resources to regulate existing properties with 3 or more acres of impervious surface – both publicly and privately owned – to meet the modern standard for stormwater treatment. Draft general permit 3090 requires these properties to apply for a permit by 2023 and come into compliance within 5 years of application. Rutland City is served by both separated (wastewater and stormwater are conveyed through separate pipes) and combined (wastewater

ANR_List_of_3-Acre_sitesand stormwater use the same pipes), depending upon where you are. PROPERTIES WITHIN THE AREAS SERVED BY COMBINED SEWERS ARE EXEMPT FROM THE 3-ACRE RULE AND THE REQUIREMENTS UNDER DRAFT GENERAL PERMIT 3090.
